By confirming a booking through the payment of a deposit or in writing, client is deemed to have agreed to the following terms in their entirety.

quantity of photos

1. Quantity of photos delivered is estimated to be at least 40 images per hour. Eg, at least 120 photos will be delivered for a 3-hour session. For collections with unlimited photos, additional photos will be delivered as well.

2. Truphotos reserves the right NOT to include images that do not meet its artistic standards and quality based on its professional judgement. Examples include repetitions, out of focus, overly dark/bright shots etc.

   Such photos will NOT be delivered to the client.

3. Every reasonable effort will be made to take requested photographs, but no specific pose or photograph can be guaranteed.

booking and delivery

1. A non-returnable, non-transferable deposit is required to confirm and secure a booking on a first-come, first-served basis. Payment of the balance shall be no later than the date of the photography service.

   Digital files will NOT be delivered until full payment is made.

2. Processing of the photographs generally takes 1 week. Printed products usually take 2-3 weeks after confirmation of the order.

3. Upon delivery, client accepts all responsibility for checking, archiving and protecting the photographs. Multiple backups of the original data are strongly recommended due to digital media being prone to failure with time. Truphotos does NOT permanently archive image files and is not responsible for any loss of data.

   Any redelivery will be dependent on file availability and will be chargeable at $100 per copy.

4. Reasonable effort will be made to ensure colour accuracy in the photographs based on professionally calibrated displays. Truphotos cannot be held responsible for a 100% colour match nor for any colour discrepancies between the client's monitor and that of the actual photographs.

cancellations

1. In the unlikely event that Truphotos is unable to complete the coverage due to unforeseen circumstances, Truphotos reserves the right to appoint another photographer to undertake the service.

2. In the unlikely event of a total technical failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of this contract. Neither party shall be liable for indirect or consequential loss.

copyright and usage of photographs

1. Copyright in the photographs is retained by Truphotos.

2. Client may print and/or display online the images received solely for personal and non-commercial use only. The unauthorised reproduction of hardcopy products is prohibited.

3. Truphotos reserves the right to use the photos in any way deemed suitable for its promotional purposes without additional approval. However, if the client prefers the photos not to be used publicly, the client will notify Truphotos in writing after receiving them.
